What’s Happening:

Democrats threatened to pack the Supreme Court soon after Trump got his third justice onto the bench.

Now that they have a slim majority in the Senate, some fear they will try to add more justices.

So far, that has not been discussed by Congress—because Democrats are obsessed with the impeachment of a man no longer in office.

But Republicans are not wasting time to make sure the Supreme Court stays at 9 members.

The Epoch Times:

Sen. Shelley Moore Capito (R-W.Va.) introduced legislation on Jan. 22 to amend the U.S. Constitution to limit the Supreme Court to nine justices, the numerical cap that has been in place for well over a century, in order to prevent Democrats from enlarging the court’s membership…

Biden flirted with the idea of court-packing during the recent campaign but didn’t endorse it, saying he would create a national commission to look at a court system he described as “out of whack.”

Sen. Shelley Moore Capito introduced the bill to set the limit of the Supreme Court to nine justices.

But doing so would require a Constitutional amendment, something that is not easy to do.

It would take 2/3rd majority from both chambers of Congress and 3/4th of the states for an amendment to be passed.

It’s unlikely Democrats in Congress will go along with these plans, even if they back down on their court-packing agenda.

And blue states will not be willing to sign onto such an amendment.

We can’t say for sure if Democrats will try to cram more justices onto the Supreme Court. The public certainly wouldn’t be on their side.

And there would surely be an uphill battle before they could do it. There might even be court challenges to any attempts by Democrats to pack the court.

But this move for an amendment signifies that Republicans in Congress are not taking this issue lying down.
